THIS SERVICE IS SUBJECT TO THE FOLLOWING CONDITIONS:
1. A Booking Fee of $________ of the above fee is payable with this contract and the balance of $_________ plus all unpaid expenses will be payable on mare's departure.
   
   
2. The mare shall be in a healthy and sound breeding condition. A veterinarian's certificate shall accompany my mare and failure to furnish this will be your authorization to have the mare examined by your veterinarian and the examination shall be done at my expense. I further acknowledge the fact that Dusty A Ranch engages the services of a veterinarian for determining optimum breeding times and for collection of the stallion for artificial insemination. I fully understand the cost of their services are pro-rated per mare and their fees are passed on to the mare owner at cost. I further agree that should the services of a veterinarian be needed to treat an injury or an illness to my mare during her stay, their services will be at my expense.
   
   
3. All unpaid charges are due and payable when mare leaves Dusty A Ranch. In the event payment is not made, Dusty A Ranch shall have a lien on the mare (or mares and foals) for all unpaid bills.
   
   
4. Dusty A Ranch agrees to diligently try to settle the mare named above and will guarantee a live foal provided that the mare does not leave Dusty A Ranch before pregnancy-checked and found to be in foal a maximum of 45 days by stallion owner veterinarian. If mare leaves Dusty A Ranch before the minimum pregnancy check then all unpaid board, shoeing, trimming, veterinary, medicine and breeding fee charges are due and payable and the live foal guarantee becomes void. If for any reason the mare does not settle, Dusty A Ranch shall be held harmless.
   
   
5. Should the mare, after being checked in foal at Dusty A Ranch, abort or not have a live foal to stand and nurse, this mare will have a return breeding privilage at no further breeding fee charge, for the next year breeding season only, providing that certification by a licensed veterinarian of the abortion or birth of a foal which does not stand and nurse, is recieved within seven days of the occurance. If the mare owner fails to deliver this mare for rebreeding the following year, then any and all fees paid shall be not be refundable and the return privilage for rebreeding is cancelled. Should conception not result after two consecutive breeding seasons of effort (breeding season is defined as the months between February 15 and July 15) on the stallion owner's part, or should said mare prove to be barren as evidenced by a certificate of qualified veterinarian, stallion owner will have earned the entire stud fee.
   
   
6. It is further agreed that should your stallion die or become unfit for service before serving my mare, or any mare, if named in the contract, dies or becomes unfit to be bred, then this contract is and shall be null and void.
   
   
7. You shall not be liable or responsible for any disease, accident or injury to my mare, and shall not be responsible or liable for any disease, accident or injury to your stallion. All reasonable precuations are to be taken for the care of my mare.
   
   
8. Mares that are unacceptable, except with special permission and at double the normal fee are as follows:
   a. Mares that are not halter broken
   
   
   
   
   
9. The accommodations furnished my mare is individual care and the costs are:
   
   
   
   
   
   
10. Mare's registration papers, or a photostatic copy must be furnished upon delivery of the mare.
    
    
11. A Breeder's Certificate will be furnished by Dusty A Ranch when mare is pronounced safe to foal.
    
    
12. The mare owner shall be responsible for reasonable attorney fees and court costs if neccessary to collect fees due.
    
    
13. Any deviation from the above terms and conditions must be put in writing and signed by both the stallion owner and the mare owner.
    
    
14. When stallion owner, by it's authorized representative, signs and returns one copy of this contract to mare owner, it will then be a binding contract on both parties, subject to the above terms and conditions, and not transferable or assigned.
